Since you are a registered user of our SOLAR platform, we would like to let you know about our updated service agreement, which will take effect on Oct. 30th,2021.

Our Agreement is updated to reflect the changes required by the EU's Common Data Protection Act.

We are committed to protecting your personal data privacy, and as part of our privacy protection practices, we emphasize that this service agreement will always apply to you as you use our platform.

In this agreement, Chengdu Saite Xinneng Technology Co., Ltd. is referred to as "We" or "Our", and "Data subject" is referred to as "You" or "Your".

  1. The services we provide

(1) Account registration

We provide you with the service of registered account through email and phone, through which you can have your own account.

(2) Create PV power stations online

You can create online power station based on the physical information of your PV station and add our collector device to the station to map your actual power station.

(3) Data acquisition

Our collectors collect data from devices such an inverter and send it to our cloud services system, which process and store the data.

(4) Big data statistics

We collect the data through the big data system, and finally display the real-time and historical data of power generation, power consumption, power grid and battery on the power station you build (depending on the device you access and the grid connection type of your power station).

(5) Data export

You can export your power station and device data in your Web system for your own further analysis.

  1. Our data policy

(1) Processing

In order to provide you with the above service, we will do the following with your personal data, these include: collection, recording, organization, construction, storage, modification, retrieval, consultation, use, disclosure, dissemination or other use, arrange, group, restrict, delete, or destroy, whether or not the operation is automated.

(2) Provision of information

When we collect personal data from you, we provide you with the following information:

  1. Our identity and contact details, as well as the identity of the representative and contact details as appropriate.
  2. Provide contact details of the data protection authority as appropriate.
  3. If available, provide information on the recipient of the personal data.
  4. The appropriate security measures we have taken.

(3) Recording

We will record and retain the personal data we collect when you use our SitSolar software for legal or commercial purpose to serve you, fulfill our legal obligations and implement our mutual agreement.

(4) Communication

We will notify the recipient of the data and information correction, deletion and disposal restrictions made pursuant to Article 3, paragraph 2/3/4/5, of this agreement, except where notification is not possible or contains inappropriate actions. At your request, we will also inform you of the status of the recipient of this information.

(5) Safety

We use reasonable technical measures to protect the information collected about your personal data. We also take a number of measures to prevent security breaches and unauthorized access to personal data.

  1. We will follow the requirements of the Act, to keep you informed of the basic situation and possible impact of the security incident, the measures we have taken or will take to deal with it, suggestions you can take on your own to prevent and reduce the risk, remedial measures for you, etc. We will timely inform you of events related through the email, letters, telephone, push notifications and other means, we will take a reasonable and effective way to publish the announcement while it is difficult to tell users one by one information subject.
  2. At the same time, we will also report the handling of user information security incidents as required by the regulatory authorities.
  3. In the event that products and services cease to operate, we will take reasonable measures to protect the security of your user information, including the timely cessation of the continued collection of your user information activities; Notice of cessation of operation will be served on you one by one or in the form of public notice; and the personal information held by you for deletion or anonymous processing.
  4. We will inform you again and seek your express consent before using your user information beyond the stated purpose for which it was collected or beyond the scope of a direct or reasonable association.

(6) Notification

In the event of a breach of personal data, we will notify the data regulator without undue delay within 72 hours of the discovery of the breach, as far as practicable, unless the disclosure of such data poses no risk to the rights and freedoms of individuals. If we do not notify the regulator within 72 hours, we will explain.

We will notify you without undue delay of the disclosure of your personal data when such disclosure is likely to endanger your rights and freedoms.

  1. Your rights

(1) Access

You are entitled to know whether we are processing your personal data and, if so, how we hold your personal data and how it is used and shared with whom. You have the right to file a complaint against the data watchdog.

(2) Rectification

You have the right to ask us to correct information about your personal data without undue delay, and you have the right to complete incomplete personal data, including by providing additional clarification.

(3) Deletion

You have the right to ask us to delete your personal data, and we have an obligation to delete your personal data without undue delay for any of the following reasons:

  1. Personal data are not necessary for the purpose of collecting or otherwise processing the data.
  2. Personal data has been illegally processed.
  3. Personal data must be deleted in order to comply with our legal obligations under EU or member state law.

(4) Restriction

In one of the following situations, you have the right to request restrictions on our data processing.

  1. You object to the accuracy of personal data and allow us to verify the accuracy of personal data within a certain period of time.
  2. The processing is illegal, and you object to the processing of the data and demand restrictions on the use of the personal data.
  3. We no longer need the personal data for the purposes of this processing, but you do need the personal data for the purpose of establishing, exercising or defending a legal right.

(5) Objection

You have the right to object to our handling of your personal data, and we will consider your request. Please provide us with the reasons for your objection so that we can assess whether we have a mandatory legal interest in continuing to process the data or whether we need to continue to process the data for legitimate claims.

  1. Your commitments

(1) You agree that your personal data may be processed by us for the purpose of providing you with the services described in clause 2(1) above. You also have the right to revoke that consent at any time. However, this revocation does not affect the legal effect of the data processing done on your consent prior to revocation.

If you do not agree to the terms of this agreement or withdraw your consent at any time thereafter, we have the right to terminate this service agreement.

(2) You agree that we may disclose your personal data to device manufacturer and installer, at our sole discretion, for assisting them to provide better service to you.

(3) You agree that you will not engage in any behavior that may interfere with proper functioning of our system and will not take any action that may undermine your data security according to our understandings.

(4) You know and agree that you have full right, with no limitation, to disclose or offer your personal information, and any liability, claim and lawsuit maybe incurred to us will be waived, as long as your data are properly used according to this Service Agreement.

(5) You know and agree that some data information you provide to us may be transferred, stored or processed in our branches and equipment service institutions involved in this Agreement. This may be different from your location, so this information may be transferred to overseas jurisdictions.

(6) You know and agree that the overseas transfer or processing of such information is necessary for the processing and management of your account and the provision of services to you, and you agree with us to do so. You further agree that we will process the information according to the terms of this agreement based on your interests, and you entrust us to transfer, store and process the data information to these countries and regions in order to provide you with the services agreed in the service agreement.

(7) You know and agree that WE have right, at our sole discretion, to remove, modify or reject any content that you submit, post or display on our SitSolar apps, as these contents, in our sole opinion, is unlawful, violating the Terms, or may incur any liability that WE or our affiliates will take.

  1. Force Majeure

Unless otherwise specified in the terms and conditions of the service, we shall not be responsible for any delay, failure or interruption of the content or service caused by direct or indirect natural acts, forces or reasons beyond our reasonable control. These factors include but are not limited to: Internet failure, computer virus, network attack, long-distance or any other equipment failure, power failure, strike, labor dispute, riot, rebellion, civil strife, labor or material shortage, fire, flood, storm, explosion, Emperor's behavior, war, government action, Orders of domestic or foreign courts or tribunals or non-performance by any third party.

  1. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the Peoples Republic of China without regard to its conflict of law provisions. The parties to this Agreement shall submit the dispute to the jurisdiction of the courts of Wuxi, China.

  1. Complaints

If you have any complaints about our data processing, we will try our best to solve your requirements.

  1. Notification of Changes

We reserve the right to modify the terms of service at any time. Please check the review frequently. If we decide to change the terms in any written form, we will notify you through SitSolar Apps before the changed version takes effect. In any event, your continued use of any service will constitute acceptance of any such change.
